Résumé: ملخص تعد الأسرة في المجتمع الأندلسي الخلية الأساسية الخاضعة للأحكام الفقهية و للعادات و التقاليد( الأعراف)، و بين أداء الواجبات و المطالبة بالحقوق حدثت مشاكل أسرية سجلت في ثنايا وثائق العقود يستشف منها الباحث معلومات مفيدة لا توفرها المصادر التاريخية. فعقد الزواج يتضمن شروط الزوجين قبل تأسيس الأسرة ، و إذا نقض أبرم عقد طلاق لإنصاف الطرفين ، فيليه عقود رعاية الأبناء... ولذا فوثائق العقود تعد مرآة تعكس صورة الأسرة الأندلسية بكل ملبساتها الإيجابية و السلبية، نهدف على ضوء هذه الدراسة تقصي مشاكل الأسرة الأندلسية و النتائج المترتبة عليها اجتماعيا من خلال دراسة وصفية و تحليلية لوثائق فقهية للغرب الإسلامي The family is in the Andalusian society the primary cell subject to jurisprudence and customs and tradition , between the performance of duties and the claim of rights, family problems occurred recorded in the folds of contract documents, from which the researcher discovers useful information not provided by historical sources. Therefore, contract documents are a mirror that reflects the image of the Andalusian family with all its positive and negative implications. We aim, in the light of this study, to investigate the problems of the Andalusian family and its social consequences through a descriptive and analytical study of doctrinal documents for the Islamic Maghreb
