العملات المشفرة البيتكوين أنموذجا (مدى مواكبة التكيف الفقهي والمشروعية للواقع المعاصر)

Résumé: ملخص: البتكوين Bitcoinهو عملة رقمية إلكترونية مشفرة، يتم تداولها عبر الإنترنت فقط، من دون وجود فيزيائي لها، وهي أول عملة رقمية لا مركزية، أي أنها تختلف عن العملات التقليدية وتتم المعاملات بشبكة الند للند، مشكلة هذا البحث في أن هذه العملة ظهرت حديثا، لذلك كان لا بد لنا من البحث والاستقراء عن هذه العملة الرقمية الأجنبية الحديثة لمعرفة مدى مواكبة المشرع الإسلامي لها، وقد تم التوصل إلى ضرورة أن تنظر المجامع الفقهية بنظرة أشمل عند اطلاق الاحكام، ويجب عليها مواكبة التطورات التكنولوجيا التي أصبحت هي البنك المركزي المتحكم في العالم وضرورة قبولها وخلق بدائل مقبولة وعالمية تتماشى معها قبل أن يجد المشرع الإسلامية نفسه يقبلها بشكل مجبر. الكلمات المفتاحية: بيتكوين، عملات مشفرة، تكنولوجيا، انترنات Abstract:Bitcoin is an currency having electronic digital code. It has been used from only Internet without having a physical existence. In addition, it is the first decentralized digital currency. So, it differs from conventional currencies because of not having central regulator establishment behind it. Transactions have been directly performed betweenthe users without an intermediary by peer-to-peer networks. It has been concluded that there are many researches, studies and fatwas related to the subject between those who support dealing in cryptocurrencies and those who are forbidden to deal with them, but there is a need for the jurisprudence councils to consider a more comprehensive view when issuing judgments, and they must keep pace with the technological developments that have become the central bank The control in the world and the necessity of accepting it and creating acceptable and universal alternatives in line with it before the Islamic legislator finds himself accepting it compulsively or de facto.
