الإطار القانوني للتأمين التكافلي في الجزائر

Résumé: جاءت هذه الدراسة لمعالجة المشكلة الرئيسية والمشكلات الفرعية المطروحة والمتمثلة في "ما واقع التأمين التكافلي في الجزائر؟" حيث الهدف الرئيسي هو التعرف على واقع التأمين التكافلي كبديل شرعي للتأمين التكافلي التجاري. تأمين؛ توضيح أهم المبادئ التي يقوم عليها التأمين التكافلي. بينما تبرز أهمية الموضوع حيث أنه يتناول موضوع التأمين التكافلي ، والذي يعتبر البديل القانوني للتأمين التجاري ، كما تم قبوله من قبل عامة المسلمين. في استكمال هذه الدراسة اعتمدنا على المنهج الوصفي ، وفي نهاية هذه الدراسة خلصنا إلى أن الجزائر تواجه تحديًا كبيرًا للنهوض باقتصادها ، والذي يشمل سوق التأمين بشكل عام والتأمين التكافلي بشكل خاص ، وتشجيع الأفراد على ذلك. اللجوء إلى البنوك الإسلامية لتشجيع استمراريتها This study came to address the main problem and the sub-problems posed, which is represented in “What is the reality of Takaful insurance in Algeria?”, where the main objective is to identify the reality of Takaful insurance as a legitimate alternative to commercial insurance; Clarifying the most important principles underlying the Takaful insurance; While the importance of the topic emerges as it deals with the issue of Takaful insurance, which is considered the legal alternative to commercial insurance, as it has been accepted by the general Muslims. In completing this study, we relied on the descriptive approach, and at the end of this study we concluded that Algeria faces a great challenge to advance its economy, which includes the insurance market in general and Takaful insurance in particular, and to encourage individuals to turn to Islamic banks to encourage their continuity
