رقابة القاضي الاداري للصفقة العمومية آلية لصيانة المرفق العام

Résumé: نتناول في هذه الدراسة القواعد المتعلقة برقابة القاضي الإداري للصفقة العمومية، وأثر ذلك في حماية والحفاظ على المرفق العام، وذلك بتسليط الضوء على مختلف أنواع الرقابة التي يملكها القاضي الإداري في مجال الصفقة العمومية. توصلنا إلى أن رقابة القاضي الإداري على الصفقة العمومية، تتجسد في كل من رقابة الإلغاء، إلى جانب رقابة القضاء الكامل، كما أن هناك نوع آخر من الرقابة يظهر في رقابة القضاء الاستعجالي ما قبل التعاقدي. وإن أنواع هذه الرقابة حاول القضاء بمقتضاها الإسهام في صيانة المرفق العام، رغم ما يعتري ذلك من عقبات تشريعية وأخرى مرتبطة بالواقع العملي. In this study, we address the rules related to the control of the administrative judge of the public deal, and the effect of that on protecting and maintaining the public facility, by highlighting the various types of control that the administrative judge has in the area of the public deal We concluded that the administrative judge's oversight of the public deal is embodied in both the cancellation control, in addition to the full control of the judiciary, and that there is another type of oversight that appears in the pre-contractual judicial control. And that the types of this control, according to which the judiciary tried to contribute to the maintenance of the public facility, despite the legislative and other obstacles .related to this in practice
