حجية القرارات الأممية واعتبارها مصدرا جديدا للقانون الدولي العام The Authority Of Un Resolutions As New Source Of International Public Law

Résumé: يعدّ القرار الدولي بالنظر للمكانة الهامة التي يحتلها مصدرا من المصادر الجديدة للقانون الدولي العام، وذلك لأنه يجسّد مضمون الشرعية الدولية ويحقّقها ويحدّ من التصرفات الانفرادية التي تغلّب المصالح الخاصة للدول متّخذة القرار دون الاحتكام للقواعد الدولية الصحيحة القانونية منها والعرفية. وعلى الرغم من الاشكالات المصاحبة لعملية تفعيل وتنفيذ القرارات الدولية، إلا أنّه لا يمكن إنكار حجيتها في إرساء قواعد قانونية عامة مجدّدة للقانون الدولي، خصوصا إذا صدرت من جهاز عالمي كالأمم المتحدة ،ممّا ينبّه لوجوب مراجعة المادة الثامنة والثلاثين من نظام محكمة العدل الدولية الدولية التي لازالت منذ وقت وضعها الأساس القانوني الوحيد لمصادر القانون الدولي. Abstract : The Authority Of UN Resolutions As New Source Of International Public Law The international decision, given its significant status, is a new source of public international law, because it embodies and achieves the international legitimacy content, and limits unilateral acts that focus only on the special interests of the decision-making States, without refer to the proper international legal and customary rules. In spite of the problems accompanying with the process of implementing and activating the international resolutions, it can not be denied its authority in founding renewed general legal rules for international law, particularly if issued by a global body such as the United Nations, which requires for revision of article 38 of the International Court of Justice, that still remain since its establishment as sole legal basis for the sources of international law.
