النظام القانوني لإستغلال العقار الموجه للإستثمار في الجزائر
Résumé: خصص المشرع العديد من المناطق لإستقبالالإستثمارات الصناعية ، تتمثل هذه المناطق في المناطق الخاصة والحرة للدولة ، المناطق المهيأة التي تتكون من المناطق الصناعية ومناطق النشاط ، وضم لهذه المناطق الأراضي المتبقية والفائضة للمؤسسات العمومية الإقتصادية ، مشكلة بذلك الوعاء الجغرافي للعقار الصناعي . لمنح هذا العقار تم الإعتماد على عقد الامتياز ، وهو الوسيلة الوحيدة التي يمكن بموجبها استغلال الاراضي الموجهة لإنجاز المشاريع الاستثمارية ، وذلك بموجب الأمر 04/08 المؤرخ في الأول من سبتمبر 2008 . Abstract : The legislature allocated many zones to receive industrial investments. These zones are in the private and free zones of the State, the prepared zones are formed in industrial zones and areas of activity. These zones are annexed to the remaining and surplus land of the economic public institutions, thus forming the geographical base of the industrial property. To grant this property, the concession contract was relied upon and is the only means by which land intended for the completion of investment projects can be exploited under the 04/08 Order of September 1, 2008.
