الملاءة المالية في شركات التأمين: بين جهود التنظيم وصعوبات التطبيق مع إشارة خاصة لحالة الجزائر

Résumé: تعد شركات التأمين من أهم المؤسسات المالية غير المصرفية، ولكي تضمن استمراريتها وبقائها وتتمكن من مواجهة والتعامل مع المخاطر التي تعتبر موضوع نشاطها، يتوجب عليها القيام بصفة دائمة بقياس ملاءتها وقدرتها على الوفاء بالتزاماتها، كما تلقى على السلطات الرقابية مسؤولية ممارسة إشراف دائم على مستوى الملاءة حفاظا على مصالح المؤمنين عليهم وضمانا لاستقرار السوق، ومن هذا المنطلق أصبح لهذه السلطات دور مهم في وضع التنظيم الملائم الذي يمكنها من تحقيق أهدافها. وبالنظر لخصوصية نشاط التأمين فانه من المهم البحث في مضمون ومستويات التنظيم للملاءة المالية والفصل بينها وبين ما هو مطبق في البنوك، كما نهدف من خلال هذا البحث إلى دراسة حالة قطاع التأمين في الجزائر في ذات المجال. The Insurance companies are considered among the most important non-bank financial institutions, and to ensure their continuity and deal with the risks that are the subject of their activities, they must continuously measure the creditworthiness and ability to meet its obligations. The control authorities are also responsible for permanent supervision to solvency level to protect the interests of the insured for themselves and for the stability of the market. Indeed, these authorities have an important role in the development of a appropriate regulation to enable them to achieve their objectives. Given the specificity of insurance activities, it is important to examine the contents and levels of regulation of the financial solvency and the separation between them and what is applied in banks. Also, we aim through this research to study the case of insurance sector in Algeria in this field.
