الحماية الجنائية للطفل الضحية

Résumé: ملخص هذه المذكرة الموسومة بالحماية الجنائية للطفل الضحية.والذي تمتد حمايته من كونه جنين في بطن أمه غلى بلوغه18 سنة, وهذا ما دفع بنا إلى طرح الإشكال الآتي:مامدى فعالية الحماية الجنائية الموضوعية التي وضعتها التشريعات العقابية للطفل الضحية؟فحاولنا الإجابة على هذا الاشكال من خلال ثلاث فصول :الفصل الأول يتناول مفهوم الطفل في مختلف التشريعات, الفصل الثاني تطرقنا من خلاله غلى الحماية الجنائية لحماية الطفل وسلامته وفصل ثالث يتضمن الحماية الجنائية لعرض الطفل وسلوكه, وقد استعنت في بحثي إلى المنهج الوصفي والتحليلي والمقارن ,أساسا بالإضافة غلى مناهج أخرى تفرضها عناصر الموضوع كالمنهج الإحصائي , ولكن ما يلفت الأنظار هو تفاقم نسبة الجرائم ضد الأطفال من الرغم من وجود نصوص عقابية تحميه ,ويمكن إرجاع هذا كون هذه النصوص غير كافية أو يشوبها قصور وهو ما سنحاول توضيحه من خلال النتائج المستنبطة من التشريع الجزائري مرفقة بالتوصيات على النحو التالي: 1-إضافة نص خاص يحمي الطفل من التحريض على الانتحار لتفشي هذا النوع من الجرائم في هذه المرحلة وكون الطفل سهل الإغراء. 2-حماية الأطفال موضوعيا من التحرش الجنسي بتجريم هذا الفعل الذي يستهدف الأطفال حتي في دار الأيتام والروض. 3- إدراج جريمتي استغلال الاطفال في ترويج المود المخدرة وتحريض قاصر على السرقة ضمن النصوص العقابية خاصة وأن هاتين الجريمتين تستهدف الأطفال بصورة موسعة. 4-تشديد العقوبات المقررة على توظيف العامل القاصر الذي لم يبلغ الين القانونية وجعلها أكثر ردعية . The abstract of this paper entitled " The criminal protection of the child victim " is shown the extended this protection begins as soon fetal life up to 18 years, which lead us to ask the following question : what is the extent of strict criminal protection established by the criminal law for the child victim, we tried to address this issue through 03 chapters: chapter I : the concept of the child in the various laws, chapter II : Protection criminal life of the child and his property be , Chapter III : the criminal protection of modesty of the child and his behavior , I used in my research mainly descriptive and analytical and comparative method, in addition to other methods imposed by the elements of the subject as the statistical method . But what attracts our attention is the increasing rate of crime against children despite the presence of criminal texts that protects , and this can be attributed to the fact that these texts are insufficient or aves gaps is that we will try to clear through the results derived from the Algerian legislation together with appropriate recommendations, and are as follows: 1 / add a special provision that protects children against incitement to suicide because of the spread of this type of crime in recent times that the child easily succumb to the temptation. 2 / objectively defend children against sexual harassment by criminalizing the act intended the same children in orphanages and kindergartens. 3 / insertion of the crime of exploitation of children in drug trafficking and inducing a minor theft in the criminal law. 4 / Increase penalties on the use of a minor who has not reached legal age and make it more deterrent.
