حماية اليتيم الجانح واليتيم الضحية في القانون الجزائي

Résumé: لقد حمى المشرع الطفل في نصوص قانونية كثيرة، غير أن هذه القوانين التي رصدها المشرع لحماية الطفل الجانح والطفل الضحية تتناول بالحماية الطفل في الأوضاع العادية. ومن هنا نتساءل عن مدى تحقيق النصوص المذكورة الحماية الكافية للطفل في الأوضاع الاستثنائية كحالة اليتيم. ثم النظر في الوضع الاستثنائي لليتيم الجانح واليتيم الضحية وما يتطلبه من عناية خاصة من قبل المشرع. The legislator has provided legal protection for children in many texts, but these laws are observed by the legislature to protect the child delinquent and the child victim dealing with child protection in normal conditions. Therefore, we wonder about the extent to which the texts cited adequate protection of the child in the special situation as a case orphan. The paper deals with the consideration of the exceptional situation of the orphan delinquent and orphan victim, and what it requires of special attention by the legislator.
