التأمين من المسؤولية

Résumé: إنّ التأمين على المسؤولية هو تأمين على دين ، فهو لا يقتصر على شخصين اثنين المؤمن والمؤمن له ، بل يمتد إلى شخص ثالث هو المضرور ، فتوجد علاقات متميزة بين المؤمن والمؤمن له من جهة وبين المؤمن والمضرور من جهة أخرى سواء كان التأمين من المسؤولية إجباريا أو غير إجباري. غير أن المشرّع الجزائري وسّع من نطاق التأمينات الإلزامية على المسؤولية أين قيد مبدأ سلطان الإرادة حيث لم تعد الإرادة حرة في تكوين هذا العقد أو حتى تحديد بنوده والتزامات طرفيه أو حتى أثاره ، و هذا لحماية الطرف المتضّرر ، وكذلك لحماية الذمة المالية للمؤمن له ممّا يعتريها من أعباء مالية ، ذلك أن هناك شخص مليء الذّمة المالية يتمثل في شركة التأمين يعوّض الضّرر الذي أصاب المتضرر . Abstract: Liability insurance is an insurance on a debt, as it is not limited to two parties , the insured and the insurance company, but extends to a third person who is the injured person. There are distinct relationships between the insured and insurance company on the one hand, and between the insured and the injured person on the other, whether the liability insurance is compulsory or not. However, the Algerian legislator expanded the scope of the mandatory liability insurance where he restricted the principle of the authority of the will , as the will is no longer free to form this contract or even specify its clauses ; the obligations of its parties or even its effects , on purpose to protect the injured party, as well as to protect the financial financial liability of the insured from what it suffers from Financial burdens, because there is a person who is full of financial liability, represented by the insurance company, who compensates the damage suffered by the aggrieved party
