الضوابط الدستورية لاجتهاد القاضي في مجال الحقوق والحريات

Résumé: يدرس هذا البحث الأسس التي يجب على القاضي مراعاتها عند اجتهاده، ويهدف إلى تحديد المقصود باجتهاد القاضي وبيان صوره، مع الإشارة إلى أهمية هذا الاجتهاد ودوره في تحقيق اليقين القضائي، وأثره في حجية الأحكام، كما يهدف إلى استقراء ضوابط اجتهاد القاضي من النصوص الدستورية، وتصنيف هذه الضوابط ضمن معايير تجمع فروعها وتبين أهميتها، ومن أهم النتائج التي توصّل إليها البحث أنّه يجب على القاضي عند اجتهاده في حكم أو تفسير أو ترجيح أن يُقدّم الاتفاقيات الدولية الـمُصادق عليها، ويقدّم أيضا المصلحة العامة عن المصالح الفرديّة، كما يجب عليه أن يراعي حقوق الآخرين وحرياتهم، ويحقّق الموازنة بين الحقوق والحريات فيما بينها. This research studies the foundations that the judge must consider when he is diligent. It aims to define the judicial discretion and clarify its forms. With reference to the importance of this discretion, and its role in achieving judicial certainty, and its effects in authority of the Judgments. It also aims to extrapolate the controls of judicial discretion from the constitutional articles. In addition, classifying these controls within criteria that gather its branches and show its importance. Among the most important results of the research is that the judge when diligent in ruling, interpreting or preferring, must prioritizes the ratified international conventions. Moreover, prioritizes the public interest over individual interests. He must also respect the rights and freedoms of others. And achieves a balance between rights and freedoms among it
