قواعد توزيع الأرباح في شركات الأموال

Résumé: تعد مساهمة كل الشركاء في الأرباح ركنا جوهريا في تكوين عقد الشركة التجارية و بالأخص شركات الأموال التي تعد من أهم خصائصها الاعتبار المالي، و في هذا الإطار اخضع المشرع الجزائري الشركاء في الشركات التجارية لقواعد مشتركة سواء بالنسبة للأرباح أو الخسائر ، و القواعد المشتركة لشركات الأموال تكون بموجب اتفاق المساهمين فيما بينهم ، و لهذا قد يعين عقد الشركة نصيب كل مساهم في الأرباح و عند ذلك توزع الأرباح القابلة للتوزيع على المساهمين طبقا لما هو معين في القانون الأساسي للشركة و إذا لم ينص القانون الأساسي للشركة على كيفية توزيع الأرباح فإنها توزع على المساهمين بنسبة مساهمة كل واحد منهم في رأسمال الشركة. The contribution of all partners in the profits is an essential pillar in the formation of the commercial company’s contract, especially the money companies, whose financial consideration is one of its most important characteristics, in this context, the Algerian legislation subjected the partners in commercial companies to common rules, both with regard to profits and losses The common rules for capital companies are according for the shareholders agreement between them for the reason , the company’s contract may specify the shareholders share in the profits ,and at that time, the distributable profits are distributed to the shareholders according to what is specified in the company’s basic law
