الاستعجال التحفظي (أو الاستعجال في مادة التدابير الضرورية) دراسة مقارنة

Résumé: ملخص: بالاعتماد على قانون القضاء الإداري الفرنسي وقانون الإجراءات المدنية والإدارية الجزائري، سنحاول في هذه الدراسة المخصّصة للاستعجال التحفّظي أو استعجال التدابير الناجعة، الإجابة على ثلاث أسئلة جوهرية: ما هو مضمون الاستعجال التحفظي، وما هي خصائصه القانونية؟ ما هي الشروط الشكلية والموضوعية لهذا الإجراء؟ ما هي الاختلافات الموجودة بين القانونين الفرنسي والجزائري في هذا المجال، بما في ذلك الاختلافات المتعلقة بإجراءات التحقيق في الطلب، وطرق الطعن في الأمر الصادر عن قاضي الاستعجال؟ ولقد خلصنا إلى أنه يوجد تقارب كبير بين القانون الفرنسي والقانون الجزائري في هذا المجال؛ سواء من حيث الشروط، أومن حيث الإجراءات، أومن حيث سلطات قاضي الاستعجال. Summary: Basing on the French code of administrative justice and the Algerian Code of civil and administrative procedure, we tried, Through this study, to which is about to the referee conservatoire or the referee of useful measures, to answer three basic questions: What is the content of procedures of the referee conservatoire and what are its legal characteristics? What are the conditions of form and substance of this procedure? What are the differences that exist between the French and Algerian law in this domain, including those related to instruction of request and available recourse against the ordinance of the administrative judge. We concluded that there is a significant convergence Between French and Algerian law In this area, Both in terms of conditions and of procedure, or in terms of the powers of the urgent applications judge.
