العلامة أبو عبد الله المقري وإسهاماته في القضاء والفتوى من خلال كتاب " نفح الطيب من غصن الأندلس الرطيب "

Résumé: الملخص: يعد القضاء من المناصب المهمة في بلاد المغرب الإسلامي، والتي لا يمكن الاستغناء عنها، فقد كان القضاء إحدى أهم المؤسسات التي تعتمد عليها الدولة للمحافظة على الأمن والاستقرار والتعليم والتوجيه، وذلك من خلال تعيين قضاة ممّن توفرت فيهم الشروط والمؤهلات العلمية والإدارية لتولي هذا المنصب، كما كانت الفتاوى والأحكام تعتمد في الغالب على المذهب المالكي رغم استمرار الضغط والاضطهاد من قبل المذاهب الأخرى. والجدير بالذكر أن نتحدث عن الإمام أبو عبد الله المقري التلمساني الذي نال حظوة لدى السلطان المريني أبي عنان وقام بتوليته منصب قاضي القضاة بفاس، وهو منصب سامي يتولى صاحبه أعلى رتبة في مجال القضاء، ويرجع إليه سائر القضاة بالنظر، حيث استمر في منصبه سبع سنوات أعلى فيها كلمة الحق ولم تأخذه في الله لومة لائم، مما ينبغي التنويه إليه أن المقري كان يلتزم بضوابط الفتوى وآداب المفتي والاعتماد على الدليل والبرهان والتوجيه بالرجوع إلى مقاصد الشريعة الإسلامية المستنبطة من القرآن والسنة بالإضافة إلى احترام آراء العلماء السابقين له، وكان يتصف بالأمانة والعمق في البحث والتحقيق. وعليه سنحاول من خلال هذا المقال التعرف على هذه الشخصية الفذّة والإبداعات التي قدمها في مجال القضاء والفتوى من خلال كتاب نفح الطيب من غصن الأندلس الرطيب للمؤلف أبو العباس المقري الذي قدم لنا الكثير عن حياة جدّه. Abstract : The judiciary is one of the most important institutions on which the State relied on to maintain security, stability, education and guidance through the appointment of judges who have met the conditions and scientific and administrative qualifications to assume this position. Fatwas and rulings were mostly based on the Maliki doctrine despite the persistence of pressure and persecution by other sects. It is worth mentioning that we are talking about Imam Abu Abdullah al-Maqri al-Talmasani, who was favored by the Marinite Sultan Abu Anan and was appointed by the judge of judges in Fez, a Sami position with the highest ranking jurist. It should be noted that al-Maqri was adhering to the fatwa rules and the ethics of the Mufti and relying on evidence, evidence and guidance by reference to the purposes of Islamic law derived from the Qur'an and Hadith, as well as respect for the views of former scholars, and was characterized by honesty Depth in research and investigation. Therefore, we will try through this article to identify this unique personality and creations he gave in the field of justice and fatwa through a book from the branch of Andalusia moisturizing author Abu Abbas al-Maqri, who gave us a lot about the life of his grandfather.
