الاجتهاد بتحقيق المناط وأثره في المسائل الطبية المعاصرة - نماذج مختارة -.

Résumé: "ملخص البحث: يتناول البحث جانبا مهما من مباحث علم أصول الفقه ألا وهو الاجتهاد في تحقيق المناط مع بيان جملة من تطبيقاته الفقهية في ضوء الاجتهاد المعاصر من خلال نماذج مختارة في المجال الطبي، وقد خلص البحث الى ان الاجتهاد في تحقيق المناط أمر اتفق عليه العلماء جملة، وأنه ضروري لكل مجتهد يروم الاستمرار في اعطاء الاحكام الشرعية، لما يستجد من نوازل فقهية وحسن تنزيلها على الواقع المتغير، فهو جزء لا ينفصل عن فهم النص لتطبيقها تطبيقا صحيحا، وأن أي ضعف في المجتهد لتحقيق المناط سيؤدي لا محالة إلى ضياع المقاصد الشرعية بين المكلفين، وتحريف النصوص عن مواضعها. " "Summary Research: The research deals with an important aspect of the jurisprudence fundamentals, namely, Ijtihad in achieving the reason with a statement of a number of its jurisprudential applications in the light of contemporary Ijtihad through selected models in the medical field. The research concluded that the reasoning is unanimously agreed upon by scholars, highly recommended for any Mujtahid who wishes to continue to give the Shariah rules, practicing them appropriately due to what’s happening on the daily life. It means that is an inseparable part of the understanding of the text to be applied correctly. Any weakness from the Mujtahid to achieve reason will inevitably lead to the loss of legitimate purposes among the taxpayers, and the perversion of the texts from their potions. "
