حماية برامج الحاسوب بقانون الملكية الأدبية أم ببراءة الاختراع -دراسة تحليلية بيانية-

Résumé: للكمبيوتر أهمية كبيرة في الحياة علميا وعمليا، وتصاعد الاهتمام به والاستعمال المتصاعد له، فحظيت برامجه بالرواج في الأسواق والتنافس لاكتسابها واحتكارها تجاريا، وباعتباره جهدا فكريا فإنه يخضع لأنظمة الملكية الفكرية، التي اختلف فيها الخبراء حول قانون حمايته، لمنع القرصنة عليه محليا ودوليا، خاصة لدى الدول المتقدمة التي تتزعم امتلاكه كالولايات المتحدة الأمريكية والاتحاد الأوروبي، وقد ذهبت بعض البلدان إلى إدراجه تحت قانون براءة الاختراع وبعضهم أدرجه تحت قانون الملكية الأدبية والفنية الذي انتهينا إلى اختياره، ويختص به حق المؤلف، إلا هذا الإنتاج العلمي يحتاج إلى مزيد من إمعان النظر في طبيعته المتميزة بتطور الأجيال، واستحداث جرائم خطيرة يصعب إثباتها :Research summary in english The computer has great importance in life scientifically and practically, and the growing interest in it and the escalating use of it. Its programs have become popular in the market and compete for their acquisition and commercial monopoly, and as an intellectual effort it is subject to the intellectual property regulation, in which experts differed about the law of its protection to prevent piracy locally and internationally., some countries have developed countries led by United States of America and the European Union, some countries have gone under the patent law and some of them included under the law of literary and artistic property, which we have chosen, and is copyright, but this a scientific needs further reflection on the nature of the evolution of distinct generation, and the development of serious crimes are difficult to prove.
