أثر اتفاقية سيداو على التشريع الأسري فيما يخص الولاية على المرأة في عقد الزواج

Résumé: يعنى هذا البحث ببعض القضايا التي تضمنتها اتفاقية سيداو في ضوء الفقه الإسلامي وما جاء به المشرع الجزائري فيما يخص اشتراط الولي من عدمه في عقد الزواج، حيث ترى العديد من الجمعيات النسوية أن شرط الولي في عقد الزواج هو مساس بحرية المرأة في اختيار زوجها، لكن نفي الولي في عقد الزواج هو مساس بأحكام الشريعة الإسلامية كما جاء به جمهور الفقهاء، وهو ما جعل المشرع الجزائري يتخذ موقفا وسطا من اشتراط الولاية في عقد الزواج، فالأول يطالب بإلغاء الولاية تماما وتخليص المرأة من الولي استجابة لاتفاقيات حقوق الإنسان وبالأخص اتفاقية سيداو، أما الرأي الثاني فيطالب بإبقاء شرط الولي كأمر واقع وكشرط من الشروط التأسيسية لعقد الزواج، ولذلك جاء المشرع بنص جديد جمع فيه بين المتناقضين حيث أنه غير عبارة " يتولى زواج المرأة وليها..." بعبارة " تعقد المرأة الراشد زواجها..." وبذلك جعل المرأة الراشدة من صفة طرف في العقد إلى صفة عاقدة، من خلال الإدلاء بموافقتها بالزوج أمام ضابط الحالة المدنية أو الموثق This research concerns some of the issues contained in the CEDAW Convention in the light of Islamic jurisprudence and Algerian Family Law Concerning the Wali's Requirement for a Contract of Marriage, where many women's associations consider the Wali’s requirement in a marriage contract to be a violation of a woman's freedom to choose her husband. But the Exclusion of the Wali in a contract of marriage is contrary to The provisions of the Islamic sharia as stated by the jurists, that what drove the Algerian legislator to Take a middle position on the requirement of Wali in the contract of marriage . The first view demands the annulment of the guardianship’s requirement and that women should be rid of it in accordance with human rights conventions and, in particular, the CEDAW Convention. The second opinion is that the Wali's requirement should be retained as a fait accompli and a condition of the contract of marriage , therefore the legislator came up with a new text in which the contradictions were combined ; He changed the phrase “The Wali takes over the woman's marriage” by “ an adult woman complicates her marriage” ,thus, the woman's role was changed from a party to a contractor through her consent to the husband before the Civil Status Officer or notary
