Islamic Banking In Algeria (reality And Challenges)

Résumé: In this study, we examined the reality of Islamic banking in Algeria by highlighting the main institutions operating in this field, whether as banks such as Al Salam Bank Algeria and Al Baraka Bank Algeria or as Islamic banking windows within conventional banks. We also analyzed the environment in which these institutions operate by reviewing the laws and regulations governing Islamic banking in Algeria. starting with Regulation 18/02 dated November 4, 2018, concerning participatory banking, followed by Regulation 20/02 dated March 15, 2020, concerning Islamic banking, and concluding with the new Monetary and Banking Law. Finally At the end of the study, we concluded that Islamic banking in Algeria has witnessed a remarkable development through the two systems: 18/02 and 20/02, but many challenges and obstacles remain, whether from within or from outside Islamic institutions. Finally, we identified the legal, human and technical requirements for the advancement of Islamic banking in Algeria قمنا في هذه الدراسة ببيان واقع الصيرفة الاسلامية في الجزائر وذلك من خلال بيان أهم المؤسسات العاملة في مجال الصيرفة الاسلامية ،سواءا كانت بنوك كمصرف السلام الجزائر ومصرف البركة الجزائري ،أو على شكل نوافذ أو شبابيك للصيرفة الاسلامية في بنوك تقليدية ،كما تناولنا أيضا البيئة التي تعمل فيها هذه المؤسسات من خلال عرض القوانين والتشريعات المؤطرة للصيرفة الاسلامية في الجزائر ابتداء بالنظام 18/02 المؤرخ في 4 نوفمبر 2018 المتعلق بالصيرفة التشاركية إلى النظام 20/02 المؤرخ في 15 مارس 2020 والمتعلق بالصيرفة الإسلامية انتهاء إلى القانون النقدي والمصرفي الجديد. حيث توصلنا في ختام الدراسة إلى أن الصيرفة الاسلامية في الجزائر شهدت تطورا ملحوظا من خلال النظامين :18/02 و20/02 ،إلا أنه تبقى العديد من التحديات والعقبات سواء من داخل المؤسسات الاسلامية أو من خارجها، وفي الأخير قمنا بتحديد المتطلبات الشرعية والبشرية والفنية للنهوض بالصيرفة الاسلامية في الجزائر.
