مشتملات النفقة بين الفقه وقانون الأسرة .الجزائري
Résumé: تعتبر النفقة من المواضيع التي أعطاها المشرع الجزائري أهمية كبرى من حيث أنها أثر من أثار الزواج و كونها من القضايا التي هي موضوع نزاع في المحاكم و المجالس و كون أن النفقة تشتمل على الغذاء و العلاج و السكن و الكسوة فإن التطرق إلى هذه المشتملات كان بدراسة موقف المشرع الجزائري من جهة و موقف الفقه من جهة أخرى. و بإعتبار أن المادة 222 من قانون الأسرة الجزائري و بنصها"كل مالم يرد النص عليه في هذا القانون يرجع فيه إلى أحكام قانون الشريعة الإسلامية" فإن المشرع الجزائري و في موضوع مشتملات النفقة قد إعتمد على أحكام الشريعة الإسلامية دون التقيد بمذهب معين Abstract of the master thesis Alimony is one of the topics that the Algerian legislator has given great importance in that it is one of the issues that are the subject of dispute in the courts and councils, and that the alimony includes food, treatment, housing and clothing, addressing these contents was a situation study. Considering that Article 222 of the Algerian Family Code and its text “Everything that is not stipulated in this law is referred to the provisions of Islamic Sharia law”, the Algerian legislator, in the matter of the contents of alimony, has relied on the provisions of Islamic Sharia without being restricted to a particular doctrine.
