ضمانات حماية المال العام ومكافحة الفساد في إطار التعديل الدستوري لعام 2020

Résumé: لقد سعت الجزائر من أجل الوصول إلى منظومة تشريعية قادرة على مجابهة ظاهرة الفساد وحماية المال العام، من خلال الاهتمام بهذه الظاهرة على مستوى النص الدستوري، خاصة ما تعلق بوضع ضمانات دستورية لحماية المال العام ومكافحة الفساد، عبر تأسيس هيئة دستورية استشارية تدعى الهيئة الوطنية للوقاية من الفساد ومكافحته، وهذا بداية من التعديل الدستوري لعام 2016. لكن بالرغم من كل الضمانات التشريعية والدستورية المكرسة لمحاربة ظاهرة الفساد وحماية المال العام، غير أنها أثبتت عجزها، في ظل هشاشة الإطار القانوني والمؤسساتي المتعلق بمكافحة الفساد والحفاظ على المال العام، لذلك كان لابد من الاتجاه نحو إصلاحات عميقة وجذرية، والبداية تكون من التعديل الدستوري لعام 2020 والذي من خلاله اتجه المؤسس الدستوري نحو معالجة كل النقائص السابقة، وهذا من خلال توسيع الأسس والضمانات الدستورية لحماية المال العام ومكافحة الفساد، غير أن كل هذه الضمانات تعتبر غير كافية، إذ يجب تدعيمها بنصوص تشريعية مجسدة لكل ما تضمنه الدستور من آليات لحماية المال العام والوقاية والتصدي لظاهرة الفساد.
