الإثبات في عقود الإستهلاك الإلكترونية

Résumé: عقود الاستهلاك الالكترونية عبارة عن تصرفات قانونية، تربط بين المورد المهني والمستهلك الالكتروني من خلال الوسائط الالكترونية الحديثة وعبر شبكة الانترنت، تتطلب جملة من الشروط لصحة إبرامها حتى تنتج آثارها القانونية، منها ما هو مستمد من القواعد القانونية العامة، ومنها ما هو مستمد من طبيعة المعاملة المبرمة عن بعد، أقرها المشرع الجزائري من خلال القانون 18/05 المتعلق بالتجارة الالكترونية. كما تولد عقود الاستهلاك الالكترونية على غرار نظيرتها من العقود التقليدية، حقوقا والتزامات متقابلة، ولكن لإثبات عقود الاستهلاك الالكترونية يجب توافر وسائل وآليات تتناسب مع بيئة إبرامها الرقمية والعالم الافتراضي، لهذا كانت المحررات الالكترونية والتوقيع الالكتروني من أهم وسائل الإثبات في هذا المجال، حيث خصها المشرع الجزائري بحماية نظمها بالقانون 15/04 الذي يحدد القواعد العامة المتعلقة بالتوقيع والتصديق الالكترونيين. Abstract: Electronic consumption contracts are legal actions that link the professional supplier and the electronic consumer through modern electronic media and internet. They require a number of conditions for their signing in order to produce their legal effects. Some of these conditions are derived from general legal rules, and others are derived from the nature of the remotely-signed transaction, approved by Algerian legislator through Law 18/05 related to E-commerce. Likewise, electronic consumption contracts generate corresponding rights and obligations, but to prove electronic consumption contracts, there must be availablemeans and mechanisms that are appropriatefor their digital environment and the virtual world. Therefore, electronic documents and electronic signatures have been among the most important means of proof in this field, as Algerian legislator singled them out by protecting their systems by the Law 15/04, which defines the general rules related to electronic signature and authentication.
