إشكالية تحديد أهلية المتعاقد الإلكتروني عبر وسائل الاتصال الحديثة

Résumé: يهدف هذا البحث بدراسة أشدّ وأصعب الإشكالات التي تواجه المتعامل الإلكتروني وهو بصدد تحديد أهلية المتعاقد الإلكتروني بغية التحقق من أهلية الطرف المتعاقد معه، والذي يتم عبر تقنيات الاتصال الحديثة، ومن دون حضور مادي للمتعاقدين، خاصة أنّ عدداً كبيراً من مستخدمي الانترنت من المراهقين وصغار السن، وقد يحدث أن يستولي القاصر على البطاقة الائتمانية الخاصة بأحد والديه، أو يستعمل توقيعه الالكتروني لإجراء بعض المعاملات على الشبكة. تعد مسألة تحديد هوية الشخص المتعاقد من أبرز الإشكاليات التي طرحت في التعامل عبر شبكة الانترنت، وذلك أنّ العقد المبرم عبر وسائل الاتصال الحديثة وفقاً للقواعد المقررة في القانون المدني كغيره من العقود لا ينعقد صحيحاً إلا إذا كان صادراً من متعاقدين تتوافر فيهما الأهلية، فلا بد من تحديد هوية كلا المتعاقدين بصورة واضحة، فتنفيذ كلّ طرف لالتزاماته يتطلب ابتداء معرفته بالطرف الأخر.
