استهداف الكيانات المتسببة في النزاعات الداخلية بالجزاءات الدولية الذكية الصادرة عن مجلس الأمن.

Résumé: الملخص: نسعى من خلال هذه الورقة البحثية إلى تحديد كيفية استهداف مجلس الأمن لكيانات من غير الدول والتي اعتبرت أعمالها السبب الرئيسي في نشوب نزاعات مسلحة داخلية، والتي قد تؤدي إلى خرق السلم والأمن الدوليين أو الإخلال بهما، وذلك من خلال التطرق إلى التبريرات القانونية التي يعتمدها مجلس الأمن في هذا الاستهداف مستغلا الاختصاصات المخولة له بموجب الفصل السابع من الميثاق. كما نبحث عن الأليات التي يلجأ إليها مجلس الأمن من أجل استهدافه لهذه الكيانات، وذلك بإنشائه لجان للجزاءات تهدف إلى التطبيق الحسن لهذه التدابير وذلك من خلال فرض رقابتها على تطبيق الجزاءات الذكية ورفعها في حالة تحقيقها لنتائجها المسطرة لها أو الخطأ في فرضها، ويكون هذا التطبيق متماشيا مع الشرعية الدولية وأن لا يتسبب في أزمات دولية إقتصادية منها أو إنسانية، ويظهر ذلك من خلال تطرقنا لعمل لجنة الجزاءات الخاصة بالأزمة الليبية واختصاصاتها في تطبيق الجزاءات الذكية المستهدفة للكيانات من غير الدول والتي تسببت بأعمالها في نشوب نزاع مسلح داخلي. Abstract: Through this research paper, we seek to examine how the Security Council targets non-State entities whose actions have been identified as the main cause of internal armed conflicts, and which may lead to breaches or breaches of international peace and security by addressing the legal justifications that Adopted by the Security Council in this regard, exploiting the prerogatives conferred on it by Chapter VII of the Charter. We are also looking for mechanisms to be used by the Security Council to target these entities by establishing sanctions committees aimed at the proper application of these measures by imposing their control on the application of smart sanctions and lifting them in the event that they achieve their established or erroneous consequences. The application is in conformity with international legality and does not cause international economic or humanitarian crises, and this is reflected in our consideration of the work of the Sanctions Committee on the Libyan crisis and its terms of reference in the application of smart targeted sanctions to non-State entities that have caused their actions in the event of armed conflict Internal.
