النظام القانوني للعملات الالكترونية- البتكوين نموذجا

Résumé: هدفت هذه الدراسة إلى إبراز أثر العمولات الرقمية على مستقبل المعاملات المالية ، نتيجة تزايد التعامل بها بين الاشخاص بدون وسيط وتطرقنا إلى عملة البيتتكوين التي تعد سلالة جديدة من انظمة العملات الرقمية المبنية إلى التشفير الرقمي محدثة بذلك ثورة في عالم المال والأعمال، فضلا عن انها تجسد تحولا تكنولوجيا غير مسبوق في مجال التداول المالي، وقد توصلت الدراسة الى ان العملات الرقمية ساهمت في تسريع المعاملات بين الاطراف، وخففت من أعباء تكلفة الوسطاء الماليين وعدم وجود جهة ضامنة للمعاملات تضمن حقوق الأطراف. لهذا اوصت الدراسة بضرورة وضع ميكانيزمات وآليات تضمن حقوق اطراف المعاملة من جهة ومن جهة ثانية الرقابة على المعاملات غير القانونية . Abstract : This study aimed to highlight the impact of digital commissions on the future of financial transactions, as a result of the increasing dealing between people without a broker and we touched on bitcoin, which is a new strain of cryptocurrency systems built into digital encryption, thus revolutionizing the world of finance and business, as well as reflecting an unprecedented technological shift in the field of financial trading, the study found that digital currencies contributed to accelerating transactions between parties, and reduced the burden of the cost of financial intermediaries. The absence of a guarantor of transactions guarantees the rights of the parties. The study therefore recommended the need to develop mechanics and mechanisms to guarantee the rights of the parties to the transaction on the one hand and on the other hand control illegal transactions.
