الوضعيات القانونية الأساسية للموظف العام. -دراسة تحليلية في ظل الأمر06-03 والمرسوم التنفيذي20-373-

Résumé: تعتبر الوضعيات القانونية الأساسية من أهم القضايا المشكلة للمسار المهني للموظف العام، باعتبارها حالات قد تصادف الموظف في حياته المهنية والاجتماعية، فيجد نفسه يوضع في إحداها، وهي تنقسم إلى نوعين وضعيات قانونية أساسية عادية تجمع بين جميع الموظفين، وأخرى استثنائية تطبق حسب توافر الأسباب الداعية لها. ونظر للأهمية البالغة التي تخظى بها، فقد خصها المشرع الجزائري بباب كامل في الأمر 06-03، بل أكثر من ذلك خصص لها نص تنظيميا هو المرسوم التنفيذي 20-373 الذي أكد على عديد الأمور المنصوص عليها في الأمر 06-03، وعمل على استحداث العديد من الإجراءات الجديدة. Basic legal postures are one of the most important issues that constitute the career of a public official, as they may come across a staff member in his or her professional and social life, and he or she finds himself or herself to be placed in one of them. They are divided into two types of ordinary basic legal positions that bring together all staff members and an exceptional one that applies to the availability of reasons for them. In view of its great importance, the Algerian legislature has devoted it to a full section of Ordinance No. 06-03. Moreover, an organizational text has been allocated to it, namely Executive Decree No. 20-373, which affirms many of the provisions of Ordinance No. 06-03, and has introduced several new measures.
