الرقابة المالية على الصفقات العمومية: بين تعدد صورها وقصور فعاليتها

Résumé: شملت حماية الصفقات العمومية آليات قانونية متعددة، أهمها الرقابة المالية على الصفقات العمومية يندرج في إطارها تدخل هيئات مالية متنوعة بدءًا بالمراقب المالي إلى المحاسب العمومي وهي هيئات رقابية مالية قبلية تُفرض قبل صرف النفقة العمومية، لتمتد الرقابة المالية لهيئات بعدية غايتها الكشف عن المخالفات والتجاوزات المالية وذلك بتدخل المفتشية العامة للمالية ومجلس المحاسبة. فالرقابة المالية على الصفقات العمومية هي تلك الرقابة التي تستمر طوال حياة ومراحل إبرام الصفقة العمومية.
