الحماية القانونية للمعلومات غير المفصح عنها وأثرها على الصناعة الدوائية. دراسة مقارنة

Résumé: الملخص: تعد الصناعة الدوائية من أهم الصناعات الحيوية على المستوى المحلي والعالمي لارتباطها الوثيق بصحة الإنسان . حيث عملت الشركات العالمية على حماية ابتكاراتها واختراعاتها الدوائية وبالأخص المعلومات غير المفصح عنها من خلال السيطرة على الأسواق العالمية للمنتجات الدوائية وتحقيق مزيد من الأرباح، دون الأخذ في الاعتبار ظروف وأوضاع الدول النامية . ومن هنا، وضعت التشريعات المقارنة حماية خاصة للمعلومات غير المفصح عنها ، تتضمن منع الغير من الاعتداء على هذه الأسرار والمعلومات باستخدام أساليب وممارسات غير شريفة عن طريق دعوى المنافسة غير المشروعة ، كما أفردت اتفاقية تريبس قواعد خاصة لحماية المعلومات غير المفصح عنها التي يلتزم تقديمها إلى الأجهزة الحكومية والجهات المعنية للحصول على ترخيص بتسويق الأدوية. Abstract : The pharmaceutical industry is one of the most important biomedical industries at the local and global level because of its close association with human health. So that international companies have worked to protect their innovations and pharmaceutical inventions, especially undisclosed information by controlling the international markets for pharmaceutical products and achieving more profits without taking into account the conditions and situations of developing countries. Comparative legislation therefore sets out special protection for undisclosed information, including preventing third parties from attacking these secrets and information by using unfair ways and practices through unfair competition. The TRIPS Agreement also sets out special rules for the protection of undisclosed information that is committed to the government agencies and entities concerned to obtain a license to market drugs.
