Résumé: الملخص: إذا كانت الشريعة الإسلامية أباحت النظر للمخطوبة والتعرف إليها، إلا أنها حرمت الاختلاء بها بغير حضور محرم لها خشية وقوع معاصي ومفاسد، لأن اختلاط الخطيبين قد ينجر عنه في بعض أحيان اتصال ومعاشرة جنسية قد ينتج عنها ميلاد طفل أثناء الخطبة، وفي هذا الصدد يثار إشكال حقيقي حول مصير الطفل الناتج عن فترة الخطبة وحقه في الانتساب للخطيبين سواء إنقلبت الخطبة إلى زواج أو تم العدول عنها بإرادة أحد الطرفين، وتهدف هذه الدراسة لمعالجة مسألة نسب الطفل الناتج عن فترة الخطبة على ضوء الفقه الإسلامي وقوانين الأسرة المغاربية.
