حق الإنسان في بيئة نظيفة وفقا لأحكام القانون الدولي

Résumé: إن موضوع دراستنا يتمحور حول حق الإنسان في بيئة نظيفة كحق حديث النشأة يندرج ضمن حقوق الجيل الثالث لحقوق الإنسان، أو ما يصطلح عليها بحقوق التضامن لما تحتاجه من تضامن جماعي وتظافر لجهود المجتمع الدولي لكفالتها بعيدا عن المصالح و الإعتبارات السياسية لكل دولة، وذلك من منطلق ارتباط هذا الحق بمسألة تصل أبعاد تأثيراتها إلى جميع الدول دون أن تقتصر على إقليم دون آخر ولا مجموعة أفراد دون أخرى، وهي البيئة التي أصبحت شأنا دوليا لاعتبارات تأثيرها العابر للحدود، ومن ثم فإن حمايتها تقتضي التعاون والتنسيق الدوليين بين أطراف المجتمع الدولي في إطار توجيه جهوده لتقنين حق الإنسان في بيئة نظيفة، واعتباره تراثا مشتركا للإنسانية تقتضي المحافظة عليه من طرف الأجيال الحالية لصالح الأجيال المستقبلية تحقيقا للعدالة بين الأجيال، ورغم كل تلك المحاولات سواء من خلال الصكوك القانونية أو الأجهزة الدولية المعنية إلا أنها لا تزال قاصرة عن إيفاء هذا المضوع حقه من الحماية. The abstract: The subject of our study is focused on the human right for a clean environment as a newly established right that falls within the third generations’ rights of the human rights, or what is termed by the rights of solidarity, for the collective solidarity and the concerted efforts of the international community to ensure that they are kept away from the political interests and the considerations of each state. As a result to the link of this right to an issue whose dimensions reach all States, without being limited to one territory or another, nor group of individuals without the other. It is the environment which has become an international issue for the considerations of its transboundary impact. Therefore, its protection requires an international cooperation and coordination among the parts of the international community as a part of its efforts to legalize the human right for a clean environment and to regard it as a common heritage of humanity that must be preserved by the present generations for the sake of the future generations to achieve justice between generations. Despite all those attempts, whether through the legal instruments or the concerned international bodies. But it still fails to fulfill its right for protection.
