المباديء التي تحكم المرافق العمومية على ضوء التعديل الدستوري 2020

Résumé: حرص التعديل الدستوري 2020 على تقنين دور المرفق العمومي للقضاء على كل المظاهر المشينة التي ترتبط بالأداء في التسيير والتي تستدعي الشفافية وكبح السلطة المطلقة، فمعظم المرافق العامة سواء كانت إدارية أو اقتصادية شكلت هاجسا كبيرا لدى المواطن جراء سوء التسيير واللامبالاة من طرف المسؤولين، ما جعل المشرع الجزائري يعمل على تكريس مواد جديدة في وثيقة الدستور أهمها نص المادة 127 الذي ضم أهم المبادئ الأساسية كمبدأ المساواة ومبدأ الاستمرارية ومبدأ الإنصاف في تغطية التراب الوطني، إلى جانب مبادئ أخرى في مواد متفرقة من الدستور كنص المادة 10 التي تضمن مبدأ المشاركة والشفافية في تسيير المرفق العام. The 2020 constitutional amendment was keen to legalize the role of the public utility to eliminate all the disgraceful aspects related to performance in management that require transparency and curb absolute power, as most public utilities, whether administrative or economic, formed a great concern for the citizen as a result of mismanagement and indifference on the part of officials, which made the legislator The Algerian works to devote new articles in the constitution document, the most important of which is the text of Article 127, which included the most basic principles such as the principle of equality, the principle of continuity and the principle of equity in covering the national territory, in addition to other principles in various articles of the constitution, such as the text of Article 10, which includes the principle of participation and transparency in the conduct of the publiract: c facility. key words: Principles public utility- equality- continuity- adaptation- fairness- transparency.
