Résumé: ملخص: إن قدسية الحياة الخاصة، والتي صانتها جل التشريعات، وأحاطتها بالآليات تكفل صونها، قد باتت على المحك، فقد أتاحت الانترنيت، بما تمتاز به من كونية وسرعة التداول، فشو دائم لبيانات تمس الأفراد وخصوصيتهم، كما أتاحت بما تملكه من قدرة على التخزين، استحضار هذه البيانات رغم مرور فترة على نشرها، مما يقوض خصوصية الأفراد ويجعل تناسي هذه البيانات أمرا معقدا، هذا الأمر أدى إلى ظهور مفهوم مستجد كأحد إفرازات الثورة التكنولوجية الرقمية، ألا وهو حق الفرد في النسيان الرقمي، أو حقه في نسيان ماضيه بما يحمله من تفاصيل ترتبط بالحياة الخاصة، لتسهيل اندماجه في المجتمع بصورة سلسة. لقد ثبت للافراد الحق في النسيان الرقمي، رغم الاختلاف بين اعتباره حق مستقل أو عنصر من عناصر الحق في الحياة الخاصة، إلا أن هذا لم يكن بالقدر الكاف، فالضوابط التشريعية الخاصة جاءت فضفاضة تستوجب الضبط، وكذا اعتماد آليات تقنية مجاورة، بهدف إحاطة هذا الحق بحماية تكفل ممارسته من قبل الأفراد. Legislative controls were loosely regulated, requiring the adoption of neighboring technical mechanisms, with a view to enforcing this right to protect individuals.
