الرقابة على ولاية المال بين الفقه الإسلامي وقانون الأسرة الجزائري

Résumé: لا يملك القاصر الحق في إدارة ممتلكاته بسبب قصوره وعدم رشده، ولا يستعيد هذا الحق إلا ببلوغه سن الرشد، وقد اختلفت التشريعات المنظمة لأحكام الولاية على القصر فيمن تعطى له الولاية على المال، غير أن كل هذه التشريعات مجمعة على ضرورة وجود رقابة من أجهزة معينة على النائب القانوني لضمان حسن تسيير الذمة المالية للقاصر، وقد نص المشرع الجزائري على آلية الرقابة القضائية لضمان حفظ هذه الأموال كما وضع نصوصا خاصة للرقابة على المال قبل إبرام التصرف وبعده . The minors do not have the right to manage their properties due to the lack of reasoning and expertise, they can only acquire the right to do so once they have reached the age of majority, although the legislations regulating the rules of legal representation of the minors have differed about whom should this responsibility be allocated to, they have however agreed that the need for the supervision on the legal representative is indispensable, accordingly the Algerian legislature have stated that judicial supervision should be performed in order to preserve the minors properties, as well as overseeing these properties before executing the legal act and there after.
