متعهد المحطة الطرفية البحرية كطرف منفذ بحري في قواعد روتردام

Résumé: تعد المحطات الطرفية نموذجا لتنظيم و ترشيد المساحات المينائية، لذا قد يمارس مشغل هذه النهائيات نشاطه، في المحطة البحرية منها، مما يطرح مسألة النظام القانوني في ظل غياب اتفاقية دولية نافذة، الأمر الذي استدعى تدخل اتفاقية الأمم المتحدة لنقل البضائع كليا أو جزئيا بطريق البحر-قواعد روتردام- لتنظيم مسؤولية هذا المتعهد تجسيدا لفلسفتها القائمة على توحيد الأحكام القانونية المطبقة على المتدخلين في عملية النقل البحري بمفهومه الحديث، بوصفه طرفا منفذا بحريا، و ذلك تطبيقا لنظرية المجموعة العقدية في صورة تجمع عقدي.و التي تسمح للمضرور أن يرفع دعوى على المتعهد المسؤول عن إحداث الضرر كطرف في ذات المجموعة، مع استعارة نظام مسؤولية الناقل المتعاقد. و هو تماثل سوف يمكّن من منح نظام قانوني لمشغلي المحطات الطرفية البحرية. It will enable a legal system to be granted to operators of offshore terminals.
