إيجاز الصّياغة في القواعد الفقهيّة: حكمه وأثره

Résumé: لئن كان المتبادر إلى الذّهن أنّ صياغة القاعدة الفقهيّة مسألة شكليّة مقطوعة عن الغرض الأسمى من التّقعيد الفقهي وهو تعرّف أحكام الجزئيّات، فإنّ الواقع يشهد بأنّ كثيرا من الإشكالات التّي تعرض للفقيه –لا سيّما المبتدئ- إبّان تطبيق القاعدة ترجع إلى الألفاظ المختارة في التّعبير عنها. وفي هذا الإطار، يتنزّل هذا البحث الذّي يُعنى بالنّظر في الإيجاز بوصفه شرطا من شروط صياغة القاعدة الفقهيّة من خلال الإشكاليّة الآتية: إلى أيّ مدى يمكن التّوفيق بين إيجاز الصّياغة في القواعد وبين المحافظة على وضوح دلالتها؟ ويعتمد البحث المنهج التّحليلي لينتهي إلى تعريف الإيجاز في مجال التّقعيد الفقهي، وبيان أنّه شرط تحسينيّ معتبر في صياغة القاعدة الفقهيّة، وأنّ تخلّفه عنها بغير موجب يجعل تلك الصّياغة معيبة، ويحمل على تعديلها وتنقيحها، والكشف عن أثر مراعاة هذا الشّرط في استحضار القاعدة وفي دفع شبهة النّقض عنها. While it comes to mind that the formulation of the jurisprudential rule is a formal matter cut off from the ultimate purpose of jurisprudential restraint, which is to define the partial provisions, the reality testifies that many of the problems that are presented to the jurist - especially the novice - during the application of the rule are due to the words chosen in their expression. In this context, this research, which is concerned with considering brevity as a condition for the formulation of the jurisprudential rule, descends through the following problem: To what extent can the brevity of the wording in the rules be reconciled with maintaining the clarity of their significance? The research ends with the definition of brevity in the field of jurisprudential refinement, and a statement that it is a significant condition in the formulation of the jurisprudential rule, and that its failure to unduly makes that wording defective, and induces to amend and revise it, and to reveal the impact of observing this condition in evoking the rule and in pushing the suspicion of cassation.
