تطور تطبيق مبدأ المسؤولية الجزائية لشركة المساهمة Evolution Of The Application Of Criminal Responsibility Of A Joint Stock Company’s Principle

Résumé: ملخص: تعتبر المسؤولية الجزائية لشركة المساهمة بصفة خاصة والشركة التجارية بصفة عامة كشخص معنوي حقيقة تشريعية، فقد تجاوزت كل مراحل الجدل الفقهي حول مدى ملائمة الأخذ بها من عدمها، إذ أقرتها غالبية التشريعات الحديثة في مختلف الدول، وقد نهجها التشريع الجزائري إثر التعديل الذي أجري على قانون العقوبات في سنة 2004، فيكون بالتالي قد نظم شروط تطبيق مبدأ المسؤولية الجزائية في القانون الجزائري سعيا منه لمواجهة الجرائم التي ترتكبها بعض الشركات التي وجدت لغايات غير مشروعة وحماية منه للأفراد والمجتمع الجزائري من أخطارها وأضرارها. Abstract : The criminal responsibility of the joint stock company in particular and the commercial company in general as a legal entity is considered a legislative fact, for it has exceeded all stages of the jurisprudential debate on it validity or not, as approved by most modern legislation in various countries , following the amendment to the Penal Code in 2004, the Algerian legislation has regulated the conditions for the application of the principle of criminal responsibility in Algerian law in an effort to counter the crimes committed by some companies found for illegal purposes and to protect individuals and society from their dangers and damages.
