خصوصية الركن المادي في الجريمة الاقتصادية

Résumé: من المقرر قانونا أنه لقيام الجريمة الاقتصادية لا بد من توافر كل من الركن الشرعي والركن المعنوي، وبدون شك توافر الركن المادي باعتباره المظهر الخارجي لها، ومن خلال هذا الأخير يتحقق الاعتداء على المصلحة المحمية قانونا، من أجل هذا يكون التحقق من توافر الركن المادي شرطا أساسيا للقول بوجود جريمة من عدمه. ولا يتميز الركن المادي للجريمة الاقتصادية عن الجرائم العادية رغم وجود بعض الاستثناءات ، اذ يتألف من السلوك الاجرامي والنتيجة والعلاقة السببية في جرائم الضرر، بينما في جرائم الخطر يتطلب توافر السلوك الاجرامي، فان تحققت هذه العناصر الثلاث (الفعل، النتيجة، العلاقة السببية) أصبح الركن المادي مكتملا وكانت الجريمة تامة.
