عوارض المسؤولية الشخصية عن عدم تنفيذ القرارات القضائية الصادرة ضد الإدارة

Résumé: الملخص: صحيح أن قيام المسؤولية الشخصية للموظف الممتنع عن تنفيذ القرارات القضائية الصادرة ضد الإدارة تعد من أهم وأبرز ضمانات تنفيذ الأحكام القضائية، إلّا أنّ تحليل النصوص المنظمة لهاته الوسيلة يبين ضعف نجاعتها في مواجهة تعنّت الإدارة ورفضها الخضوع للمشروعية، فالتمعّن في كل نوع من المسؤوليات المقامة ضد هذا الموظف يظهر عدم جدوى كل واحدة منها، وهذا الفشل يظهر من خلال النقص والقصور الذي يعاني منه النظام القانوني لكل نوع من أنواع هذه المسؤولية، سواء المسؤولية الجزائية أو المسؤولية المدنية أو المسؤولية التّأديبية أو حتى المسؤولية المالية للموظف الممتنع عن التنفيذ.
