الآليات القانونية لحل المنازعات الجمركية
Résumé: الجريمة الجمركية من أخطر الجرائم التي تهدد العالم حديثا حيث انها تتميز بطابعها الخاص عن الجريمة في القانون العام، والجريمة الجمركية تتمتع بخصائص كونها تمس بالاقتصاد الوطني. وتستخدم إدارة الجمارك لإثبات الجريمة الجمركية إجرائيين وذلك عن طريق محضر الحجز أو عن طريق محضر المعاينة أي التحقيق الجمركي، وهناك طرق أخرى تتمثل في القيمة الثبوتية التي اضافها المشرع لإثبات المخالفات الجمركية. وللمتابعة القضائية طريق آخر يتمثل في التسوية الودية للمنازعة الجمركية او بمعنى اخر يطلق عليها بالمصالحة الجمركية والتي تهدف الى تحقيق دور هام من الناحية الاقتصادية. Summary: Customs crime is one of the most dangerous crimes threatening the world recently, as it is distinguished by its special nature from crime in common law, and customs crime has the characteristics of affecting the national economy. The Customs Administration uses two procedural procedures to prove the customscrime, through the seizure report or through the inspection report, that is, the customs investigation. There are other methods, represented by the probative value that the legislator added to prove customs violations. There is another way for judicial follow-up, which is the amicable settlement of the customs dispute, or in other words, it is called customs reconciliation, which aims to achieve an important role from an economic standpoint
