اثر الاكراه والتدليس على عقد الزواج

Résumé: ملخص:ان جوهر العقد واساس وجوده هو تلاقي ارادة المتعاقدين ومن هذا التلاقي ينشأ التراضي والذي يمثل اساس كل اتفاق وتدور الدراسة هنا حول عقد الزواج وما قد يؤثر فيه من عيوب الارادة كالاكراه والتدليس، و الزواج بالاكراه معناه الزواج بعنصر او اكثر من عناصر الاحتيال او القوة حيث لا يوافق الطرفان على هذا الزواج، والتدليس في الزواج هو اجراء تغيرات في العادات او نمط الحياة أدفع الطرف الاخر القبول بهذا الزواج ،فقد يقوم الزواج واولياء الامور باخفاء العيوب عن بعضاهم البعض،والذي يكون له أثار على الاسرة والمجتمع، وقد خلص البحث الى وجوب وضع قوانين تنظم موضوع عيوب الارادة عند ابرام عقد الزواج. Abstract : Contract essence and its existence are justified by meeting emergesconset winch représentés thé basis of evrery agreement, thé study revolveshere around marriage contract and what may effect him from defects will as violence and fraud,and force marriage mean a marriage whith one or more élément of fraud or force where both parties do not consent to thé marriage, and fraud in marriage IS having change to habits or lifestyle to punch thé other party to accepte this marriage, many couples and parents may hide defects from each others, whitch IS having divastating effects on thé family and society, thé study concluded thé necessity to législation of laws whitch regulate thé issue of consent defects in marriage. t
