الضمان الاجتماعي الأروروبي والوضعية القانونية للعمال الاجانب العرب

Résumé: إن الضمان الاجتماعي حقا من حقوق الإنسان وللعمال خاصة سواء داخل الوطن أو خارجه لذا يجب معرفة الشروط الواجب توافرها في المستفيدين، وتجسيد مبدأ المساواة والآثار القانونية المترتبة عن ذلك سواء من حيث الجانب النظري أو العملي. هذا ما يؤدي إلى ضرورة دراسة الحماية القانونية، والضمانات للعمال الأجانب، وأيضا معرفة ما إذا كان العامل الأجنبي لا يتمتع بمنافع الضمان الاجتماعي لبلده الأصلي فهل يستطيع الاستفادة من تلك المنافع وفق تشريعات الضمان الاجتماعي لبلدان الإقامة؟ Social security is a human right and especially workers' right inside or outside country, so the conditions must be known for the beneficiaries, and the principle of equality and the legal consequences must be reflected both in theory and in practice. This leads to the need of studying the legal protection, guarantees for the foreign workers, and also whether a foreign worker has the right of the social security benefits of his original country. So does he have the right of those benefits according to the social security legislation of the residence’s country?.
