الحماية الجنائية للخصوصية المعلوماتية في التشريعين الجزائري والفرنسي

Résumé: الملخص: يعتبر الحق في الخصوصية من الحقوق الأساسية للإنسان، والذي يتعرض للعديد من الانتهاكات ، ومع الانتشار الواسع الذي شهده التطور التكنولوجي ظهر نوع جديد من الاعتداءات يمس البيانات الشخصية للفرد و بالتالي ينتهك خصوصيته المعلوماتية، وهذا ما دعا المواثيق الدولية والتشريعات الداخلية إلى إيجاد حلول قانونية لردع هذا النوع من الاعتداءات، ومن هذا المنطلق تتمحور هذه الدراسة حول المقصود بالخصوصية المعلوماتية والبيانات الشخصية، والحماية الجنائية المقررة لهذه البيانات في ظل التشريع الجزائري والتشريع الفرنسي الذي يعتبر من التشريعات الرائدة في هذا المجال، ومثال يحتدى به في سن قواعد قانونية صارمة ومباشرة في حماية الخصوصية المعلوماتية . Abstract: The right to privacy is one of the fundamental rights of the human being, who is subject to many violations, and with the widespread prevalence in technological development, a new type of aggression has appeared that affects the personal data of the individual and thus violates his information privacy, and this is what called international covenants and internal legislation to find legal solutions to deter this Kind of attacks, From this standpoint, this study revolves around the intended information privacy and personal data, and the criminal protection prescribed for this data in light of the Algerian legislation and the French legislation that is considered one of the pioneering legislations in this field, and an example to be followed in enacting strict and direct legal rules in protecting information privacy.
