إشكاليات إخضاع أهلية الملتزم الصرفي لحكم المادة 10 مدني جزائري-دراسة مقارنة-

Résumé: يتم الرجوع في تحديد القانون الذي يحكم أهلية الملتزم الصرفي في التشريع الجزائري إلى أحكام القواعد العامة في القانون المدني وبالأخص لنص المادة 10 مدني جزائري الخاصة بأهلية التصرفات القانونية وذلك في ظل غياب نص خاص بأهلية الالتزامات الصرفية. وتقضي هذه المادة بخضوع الأهلية لقانون جنسية الشخص، وهو نفسه المبدأ الذي أقرته اتفاقية جنيف بخصوص أهلية الملتزم بالورقة التجارية. غير أن الاختلاف في أحكام الجنسية من دولة إلى أخرى من حيث اكتسابها وفقدها واستردادها وحلول تنازعها، من شأنه أن يؤدي على الصعيد الدولي إلى وجود أشخاص يتمتعون في وقت واحد بأكثر من جنسية وأشخاص لا يتمتعون بأية جنسية. وكذا إمكانية لجوء الأجنبي ناقص الأهلية بمقتضى قانونه الوطني إلى طرق احتيالية لإخفاء نقص أهليته. وهذه الحالات تمثل إشكاليات في تطبيق نص المادة 10 على أهلية الالتزام الصرفي، مما يستدعي البحث عن الحل تحت رداء المبادئ العامة للقانون الدولي الخاص. These cases are problematic in applying the article 10 provision to the incapacity of commercial obligation, which calls for the search for a solution under the general principles of private international law.
