التجديد الفقهي عند الصوفية، محي الدين بن عربي في الفتوحات المكية انموذجاً

Résumé: ملخّص: تحاول هذه القراءة تسليط الضؤ على دور الصوفي في علم الشريعة (الفقه) وتجديدها، مثلما له الأثر الكبير في علم الحقيقة وتطويرها، وهل لبعض الصوفية الكبار فعل فقهي كما كان لهم السبق في الفعل الصوفي. بناء على ما سبق فإن هذه الورقة تتناول الجانب الفقهي في فصول من كتاب "الفتوحات المكية" للشيخ محي الدين بن عربي ومحاولة معرفة مدى التجديد في هذا الجانب وقضاياه الاجتهادية المتصلة، وطريقة استنباط الأحكام ومنهجية ترجيحها، وهل للشيخ ابن عربي اجتهاداته الفقهية الخاصة، وهل هو مقلد لمذهب فقهي معين أم له مذهبه الخاص بناء على ما ظهر له من الدليل؟ Abstract: This reading attempts to shed light on the role of the Sufi in the science of Sharia (jurisprudence) and its renewal, just as it has a great impact on the science of truth and its development, and does some of the big Sufis have a juristic act as they had a head start in the Sufi act. Based on the foregoing, this paper deals with the juristic aspect in chapters from the book "The Meccan Conquests" by Sheikh Mohiuddin bin Arabi and trying to find out the extent of renewal in this aspect and its related jurisprudential issues, the method of eliciting judgments and the methodology of its weighting, and does Sheikh Ibn Arabi have his own jurisprudence, and is it Imitating a specific jurisprudence, or has its own doctrine based on the evidence it has shown?
