الغرامة القضائية وفقاً لمبادئ اليونيدروا: دراسة مقارنة

Résumé: تهدف هذه الدراسة إلى التعرف على الغرامة القضائية وفقاً لمبادئ اليونيدروا، وذلك من حيث توضيح الطبيعة القانونية للغرامة القضائية وفقاً لمبادئ اليونيدروا، والتعرف على أحكام الغرامة القضائية، ومدى إمكانية تبنيها في القوانين المدنية كونها جاءت ضمن قانون مدني نموذجي متفق عليه دولياً.وقد خرجت الدراسة بالعديد من النتائج أهمها إن مفهوم الغرامة القضائية حسب قواعد اليونيدروا هي: "غرامة مالية يدفعها الطرف الذي يمتنع عن الامتثال لأمر المحكمة ولم يباشر بالتنفيذ". وقد أوصت الدراسة المشرع الفلسطيني قبل تطبيق مشروع القانون المدني الفلسطيني، أن يوجه نظره نحو مبادئ اليونيدروا فيما يخص أحكام الغرامة التهديدية، وان يكون الهدف من الغرامة القضائية هو احترام احكام المحكمة. Abstract: This study aims to identify the judicial fine in accordance with the principles of Unidroit, in terms of clarifying the legal nature of the judicial fine in accordance with the principles of Unidroit, and to identify the provisions of the judicial fine, and the extent to which it can be adopted in civil laws as it came within an internationally agreed model civil law. One of the most important results is that the concept of a judicial fine according to the Unidroit rules is: “a financial fine paid by the party who fails to comply with the court order and does not initiate implementation.” The study recommended that the Palestinian legislator, before applying the Palestinian civil law draft, direct his attention to the principles of Unidroit with regard to the provisions of the threatening fine, and that the aim of the judicial fine is to respect the court rulings.
