حماية المستهلك من الإشهار الإلكتروني المضلل

Résumé: " برغم أهمية الإشهار الإلكتروني ودوره في تنوير المستهلك باعتباره وسيلة لتعريفه بالمنتج أو الخدمة المُشهر عنها، إلا أنه وبالنظر لطبيعة المعاملات الرقمية وعدم قدرة المستهلك على معاينة السلعة أو المنتج مادياً نظراً للبيئة الإفتراضية التي تتم بها عملية الإشهار الإلكتروني، إضافة لإنتهاج المورد لأساليب الخداع والتضليل في الرسالة الإشهارية، أصبح الإشهار أداة لتضليل المستهلك والتأثير على إرادته وحقه في الإختيار من طرف المورد الإلكتروني. الأمر الذي استدعى من التشريعات سنّ أحكام وضوابط ورصد جزاءات مدنية وجنائية تضمن للمستهلك الحماية الفعاله في مواجهة الإشهار المضلل، ومن هنا جاءت هذه الدراسة بهدف البحث في الحماية التي كفلها المشرع الجزائري للمستهلك من مخاطر الإشهار الإلكتروني المضلل. "Abstract : Despite the importance of electronic advertising and its role in enlightening the consumer as a means of introducing him to the advertised product or service, yet regarding the nature of digital transactions and the consumer’s inability to the physical inspect of the commodity or product due to the virtual environment in which the electronic advertising process takes place, in addition to the producer’s use of cheating methods in the Advertising message, advertising has become a tool to mislead the consumer and influence his will and his right to choose by the electronic advertiser. This required legislation to enact provisions, controls, and monitor civil and criminal penalties to ensure effective protection for the consumer in the face of misleading advertising. Hence, this study came with the aim of researching the protection guaranteed by the Algerian legislator to the consumer from the dangers of misleading electronic advertising. " "
