الدراسات التقنيّة كآلية للرقابة القبليّة على البيئة في التّشريع الجزائري

Résumé: أصبح الإنسان يؤثر و يتأثر بالطبيعة بشكل كبير خاصة بعد الثورة الصناعية وما صاحبها من تلوث للبيئة, حيث حذر المختصين من مغبة الوقوع في كوارث بيئية أكبر نظرا للوتيرة المتسارعة التي يشهدها قطاع التنمية الصناعية و الإقتصادية . هذا الأمر استدعى تدخل المختصيين و السلطات العامة في الدولة لتنظيم النشاطات الإنسانية للحد من آثارها السلبية على البيئة, و ذلك بفرض إجراءات وقائية في شكل رقابة قبلية على الأنشطة المراد ممارستها , و إجراءات أخرى علاجية ردعية في حال ما تم تجاوز الخط الدفاعي الأول. و نظرا لأهمية الرقابة القبلية في تفادي حدوث خسائر بيئية يصعب تداركها فيما بعد, نسلط الضوء على آلية من آليتها المتمثلة في الدراسات التقنية التي تعتبر بمثابة المرحلة التمهيدية لإتخاذ القرارات الإدارية, و ذلك لبحث مدى فعاليتها في تحقيق التوازن البيئي. : Abstract Humans are a part of nature, they become greatly affected by nature, especially after the Industrial Revolution and the pollution of the environment caused by it; So that the specialists warned of the consequences of falling into more environmental disasters due to the fast pace of the industrial and economic development sector. This required the intervention of specialists and public authorities in the state to regulate the human activities to reduce their negative effects on the environment, by imposing preventive measures in the form of pre-control of some of the tasks to be practiced, and other remedial anddeterrent measures in case of exceeding the first line of defense. Given the importance of the pre-control in preventing environmental losses that can not be remedied later, we highlight one of its mechanism of the technical studies, which is considered as the preliminary stage of taking the administrative decisions, in order to examine its effectiveness in achieving the environmental balance.
