مدى تجانس تنظيم الصفقات العمومية مع القانون 01/06 المتعلق بالوقاية من الفساد ومكافحته

Résumé: يعد تنظيم الصفقات العمومية أحد أهم النصوص القانونية التي تحكم أهم القنوات القانونية لإنفاق المال العام والمتمثلة في الصفقات العمومية، لذا وجب أن يلتزم التجانس مع إستراتيجية المشرع الجزائري التي إعتمدها للوقاية من الفساد، وقد خلصنا إلى أن تنظيم الصفقات العمومية يتصادم في نقاط جوهرية معينة مع ما جاء به القانون 06/01 من مبادئ وتدابير لوقاية الصفقات العمومية من الفساد سواء بطريقة مباشرة أو غير مباشرة.
