ضوابط مدة الحبس المؤقت عبر تعديلات قانون الإجراءات الجزائية الجزائري

Résumé: تناولت بالبحث والدراسة جانبا من مواد الإجراءات الجزائية، مركزا على نقطة جوهرية في موضوع الحبس المؤقت من خلال التعديلات المتتالية التي مسّت قانون الإجراءات الجزائية، ألا وهي مدته والتي تعتبر من بين الشروط الموضوعية للحبس المؤقت، كما أنها من أهم الضمانات القانونية التي تكفل مباشرته في نطاق الشرعية الإجرائية، لما ينجر عن مخالفتها من إهدار لمفهوم قرينة البراءة، ويفتح المجال أمام السلطة التقديرية لقاضي التحقيق، ما دفع بالمشرع إلى التدخل لضبطها وتحديد الآجال القصوى لتمديدها بموجب نصوص قانونية صريحة وفي ذلك ضمانة جدّ هامة للمتهم، غير أن الأمر يتطلب مبادرة فعّالة لتقليص هذه المدة تجسيدا للطبيعة الاستثنائية للحبس المؤقت المكرسة بالمادة 44 من الدستور والمادة 123 من قانون الإجراءات الجزائية. It examined some of the articles of criminal procedure, focusing on a fundamental issue of temporary detention, namely, its duration through successive amendments to the Code of Criminal Procedure. The period of time is one of the substantive conditions for temporary detention and is one of the most important legal guarantees for its initiation within the scope of procedural legality, in view of the fact that any violation of the concept of the presumption of innocence has resulted in a loss of discretion on the part of the investigating judge, which has led the legislator to intervene in order to seize it and establish the maximum time limits for its extension under explicit legal provisions. However, an effective initiative is required to reduce this period in order to reflect its exceptional nature, enshrined in article 44 of the Constitution and article 123 of the Code of Criminal Procedure.
