مستجدات النظام القانوني للعقار الصناعي في ظل قانون 23-17

Résumé: نجم عن تضخم الإطار المؤسساتي الخاص بإدارة وتسيير العقار الصناعي، وتعارض النصوص القانونية المنظمة له تأخر في تجسيد المشاريع الاستثمارية، لأجل عمدت السلطات الجزائرية إلى مراجعة نظامه القانوني وإقرار آليات تتماشى مع مقتضيات قواعد القانون الدولي في مجال الاستثمار. تهدف هذه الورقة البحثية إلى تسليط الضوء على الأحكام الجديدة المنظمة لإدارة واستغلال العقار الصناعي في قانون 23-17 المحدد لشروط وكيفيات منح العقار الاقتصادي التابعة لأملاك الدولة الموجه لانجاز مشاريع استثمارية ونصوصه التنظيمية، وتوضيح البدائل المكرسة من طرف السلطات الجزائرية لزيادة عرض العقار الصناعي، وتهيئته عبر استحداثها لوكالات متخصصة، وكذا الصلاحيات الجديدة المسندة للوكالة الجزائرية لترقية الاستثمار لضبط استغلال العقار الصناعي، واستقبالها لملفات المستثمرين ومعالجتها رقميا عبر المنصة الرقمية للمستثمر إرساء لمبادئ الشفافية والمساواة المتضمنة في قانون 22-18 الخاص بالاستثمار، بالإضافة إلى منحها الحق الحصري في منح العقار الصناعي للمستثمرين.The inflation of the institutional framework for the management and management of industrial real estate, and the conflict with the legal texts regulating it, resulted in a delay in the implementation of investment projects, so the Algerian authorities decided to review its legal system and approve mechanisms that are consistent with the requirements of the rules of international law in the field of investment. This research paper aims to shed light on the new provisions regulating the management and exploitation of industrial real estate in Law 23-17, which specifies the conditions and modalities for granting economic real estate belonging to state property directed to the implementation of investment projects and its regulatory texts, and to clarify the alternatives devoted by the Algerian authorities to increase the supply of industrial real estate, and prepare it through... Its creation of specialized agencies, as well as the new powers assigned to the Algerian Investment Promotion Agency to control the exploitation of industrial real estate, and its reception of investor files and processing them digitally via the digital investor platform, establish the principles of transparency and equality included in Law 22-18 on investment, in addition to granting it the exclusive right to grant industrial real estate to investors.
