التفريق بين الزوجين بسبب الردة

Résumé: ملخص : تناولت هذه المذكرة موضوع التفريق بين الزوجين بسبب الردة، وهدفت إلى بيان مفهوم التفريق والردة وانواع التفريق و اسبابه ، كما ركزنا على التفريق بين الزوجين بسبب الردة واثار هذا التفريق، وقد وفقنا الله سبحانه وتعالى إلى تقسيم هذا البحث إلى : مقدمة، وفصلين، وخاتمة . أما المقدمة: فتكلمنا حول أهمية الأسرة في المجتمع و الدور الذي تمثله، وكيف تكون الردة لأحد الزوجيين سبب في هلاك الاسرة و منه تدهور المجتمع، وتناولنا فيها اسباب اختيارنا لهذا الموضوع و اهمية الموضوع و اهدافه. والفصل الاول: فعرضنا فيها مفهوم التفريق و أسبابه و أيضا أنواعه من الشقيين الفقهي و القانوني و ركزنا د ا رستنا على المفاهيم و تعريفات الاصطلاحية. أما الفصل الثاني: فتمثل في التعريف بالردة و المرتد و عقوبته و اثر تفريق الزوجين بسبب الردة قبل الدخول و بعده و إختلافات الفقهاء، و تناولنا ايضا سلطة القاضي في التفريق بين الزوجين، و تكلمنا في النهاية حول التفريق بين الزوجين إباء الاسلام و الاختلافات الواقع في التفريق قبل الدخول و التفريق بعد الدخول و الأثار المترتبة على ذلك وقت وقوع الفرقة و الأثار المترتبة على المهر. وخاتمة بأهم النتائج المتوصل إليها . الكلمات المفتاحية : التفريق، الردة، التفريق بين الزوجين، الإباء.. ملخص Abstract : This note dealt with the issue of separation between spouses due to apostasy, and aimed to explain the concept of separation and apostasy and the types of separation and its causes. An introduction, two chapters, and a conclusion. As for the introduction: we talked about the importance of the family in society and the role it represents, and how the apostasy of one of the spouses is a reason for the destruction of the family and from it the deterioration of society, and we discussed the reasons for our choice of this topic and the importance of the topic and its goals. The first chapter: In it, we presented the concept of segregation and its causes, as well as its types from the jurisprudential and legal sides, and we focused our study on the concepts and definitions of terminology. As for the second chapter: it is represented in the definition of apostasy and the apostate and its punishment, and the effect of separating the spouses because of apostasy before and after consummation, and the differences of the jurists, and we also dealt with the authority of the judge in separating the spouses In the end, we talked about the separation between the spouses, the fathers of Islam, and the differences that occur in the separation before consummation and the separation after consummation, and the implications of that at the time of separation and the implications of the dowry And a conclusion with the most important findings.
